Doctor Koo spoke to me today about treaty negotiations. He said that while other outstanding points could easily be settled, the question of new territories may hold the matter up indefinitely with very bad results to our relations. suggested that a possible solution might be for His Majesty's Government to make a declaration, apart from the treaty, similar to that made at Washington Conference about Weihaiwei, to the effect that His Majesty's Government intended to return leased territory to China and would enter into discussions at a later date as regards future arrangements.

2. I pointed out that His Majesty's Government were not prepared to deal with this question in present negotiations and that this suggestion would not be acceptable. I then said that I had thought of suggesting to you that the Chinese Government might inform us of their desire to raise this matter, though it was not related to the treaty negotiations.

I could not say whether you would approve of this nor what reply would be made but I thought it possible it might be on some such line as an expression of willingness to discuss the question after victory has been won. This was only my personal opinion as my instructions were that His Majesty's Government regarded the question as entirely outside the scope of the present negotiations. Doctor Koo said that he felt that the Chinese Government could not be satisfied with anything which did not convey the readiness of His Majesty's Government to terminate lease.
